These Terms of Service (“Terms”) govern your access to and use of the website and services provided by NexTranslate Private Limited (“NexTranslate”, “we”, “our”, or “us”). By using our website, submitting a project, or entering into a contract with us, you agree to these Terms.

1. Services We Offer

NexTranslate provides professional translation, localization, transcreation, machine translation post-editing (MTPE), linguistic quality assurance (LQA), and related language services. Services may be offered as one-time projects or through ongoing/retainer contracts.

2. Client Responsibilities

As a client, you agree to:

Provide accurate project requirements, source content, and delivery timelines
Respond promptly to queries or feedback from our team
Pay agreed-upon fees as outlined in project quotes or invoices
Review deliverables and notify us of any issues within the agreed timeframe

You are solely responsible for the legality and appropriateness of the content you provide.

3. Payment Terms

Quotes are provided in advance based on language pair, content type, and service level
Payments are due within the agreed terms (e.g., 7/15/30 days from invoice)
Late payments may incur interest or result in project delays
We accept payment via bank transfer, credit/debit cards, PayPal, or Upwork (for freelance contracts)

NexTranslate reserves the right to withhold final deliverables until payment is received in full.

4. Revisions & Refunds

Each project includes one round of revisions unless otherwise agreed
Revisions must be requested within 7 days of delivery
Refunds are considered only if services are not delivered or if we fail to meet agreed quality standards

5. Confidentiality

We treat all client content and information as confidential.

All linguists and team members are bound by non-disclosure agreements (NDAs)
We do not share or reuse client content without written consent
We follow industry-standard data protection and file security practices

If you require a signed NDA or DPA, please contact us.

6. Intellectual Property

All translated or localized content becomes your property upon full payment.

You retain all rights to your original content. We retain no rights to reuse or publish any deliverables unless otherwise agreed in writing.

7. Acceptable Use

You agree not to:

Submit content that is illegal, discriminatory, hateful, or violates the rights of others
Attempt to exploit, copy, or harm our website or proprietary workflows
Misuse our contact forms, tools, or services for spam or malicious purposes

Violation of these conditions may result in termination of service without notice.

8. Limitation of Liability

While we strive for 100% accuracy, NexTranslate shall not be liable for:

Indirect, incidental, or consequential damages from the use of translated materials
Delays caused by technical issues, third parties, or force majeure events
Errors in source material provided by the client

Our liability, under any circumstances, is limited to the amount paid for the specific service in question.

9. Termination

You may terminate a project at any time by providing written notice.
If work has already started, partial or full charges may still apply based on progress. NexTranslate may also terminate a project in case of non-payment, abuse, or unresolvable disputes.

10. Changes to These Terms

We may update these Terms occasionally. The updated version will be posted on this page with a new “Last Updated” date. Continued use of our services implies acceptance of the latest version.

11. Governing Law

These Terms are governed by the laws of the Republic of India.
Any disputes shall be resolved under the jurisdiction of courts located in Vridhachalam, India.
