Terms of Service

These Terms of Service (“Terms”) govern your use of the website and services provided by NexTranslate Private Limited (“NexTranslate,” “we,” “our,” or “us”). By using our website, submitting a project, or engaging our services, you agree to these Terms.

1. Services We Provide

NexTranslate offers a comprehensive suite of language services, including professional translation, localization, transcreation, machine translation post-editing (MTPE), and linguistic quality assurance (LQA). We support both one-time projects and ongoing or retainer-based engagements.

2. Client Responsibilities

Clients agree to:

  • Provide clear project specifications, source content, and realistic deadlines
  • Respond promptly to questions or feedback from our team
  • Pay all fees as agreed in quotes or invoices
  • Review and approve deliverables, and report any issues within the agreed period
  • Ensure the content you provide is legal, appropriate, and free from copyright violations

You are solely responsible for the legality and appropriateness of the content you provide.

3. Payment Terms

  • We issue quotes based on language pair, content type, and service level

  • Invoices are payable within the agreed timeframe (e.g., 7, 15, or 30 days)

  • Late payments may incur interest or impact project timelines

  • Accepted payment methods: bank transfer, credit/debit card, PayPal, or Upwork (for freelance arrangements)

  • We may withhold final deliverables until full payment is received

4. Revisions & Refunds

  • Each project includes one round of revisions, unless stated otherwise

  • Revision requests must be submitted within 7 days of delivery

  • Refunds are issued only if we fail to deliver services as agreed or if there are material quality issues

5. Confidentiality

  • All client information and content are treated as strictly confidential
  • Our linguists and team members sign non-disclosure agreements (NDAs)
  • We do not reuse or distribute your content without your written consent
  • We adhere to industry-standard data protection practices to safeguard your projects

6. Intellectual Property

  • All translated or localized output becomes your property once payment is complete
  • You retain full ownership of your original content; we claim no rights to reuse or publish unless explicitly agreed in writing

7. Acceptable Use

Clients must not:

  • Submit content that is illegal, hateful, discriminatory, or violates others’ rights

  • Use our platform, forms, or services for spam, hacking, or malicious behavior

  • Misappropriate or interfere with our workflows or proprietary tools Violations may lead to termination of services without notice.

8. Limitation of Liability

  • NexTranslate is not liable for indirect, incidental, or consequential damages from translated materials
  • We are not responsible for delays resulting from force majeure, third-party issues, or technical disruptions
  • Liability for any error in source content lies with the client
  • Our total liability is limited to the amount paid for the relevant service

9. Termination

  • You may terminate a project at any time via written notice
  • If the project has started, costs will be prorated based on work completed
  • We reserve the right to terminate in cases of non-payment, misuse, or other material breaches

10. Modifications to These Terms

We may update these Terms periodically. We’ll publish any changes on this page with a revised “Last Updated” date. Continued use of our services implies acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the Republic of India. Any disputes will be resolved exclusively in the courts located in Vridhachalam, Tamil Nadu.
